Welcome to branding.alexbeloev.com (the “Site”). These Terms & Conditions (“Terms”) govern your use of the Site and all services offered by Alex Beloev, including branding consultations, design deliverables, and digital assets. By accessing or using the Site, you agree to comply with these Terms. If you disagree, please refrain from using the Site.
1. Acceptance of Terms
By using the Site, you confirm that you are at least 18 years old and have the legal capacity to enter into binding agreements. These Terms apply to all visitors, users, and clients, including those accessing services via the Site or through direct engagement.
2. Services and Deliverables
Services provided include but are not limited to brand strategy, visual identity design, logo creation, and brand guidelines documentation. All deliverables are provided in digital format unless otherwise agreed in writing. Final files are delivered via secure download links or email. Revisions are subject to the package terms outlined at the time of purchase.
3. Intellectual Property
All original content, designs, logos, and brand assets created by Alex Beloev remain the intellectual property of Alex Beloev until full payment is received. Upon full payment, clients receive a perpetual, worldwide, non-exclusive license to use the final deliverables for their business purposes. Ownership of source files (e.g., layered PSD, AI) may be transferred upon written agreement and additional fee. Trademark registration and domain ownership are the sole responsibility of the client.
4. Payments and Refunds
Payment terms are specified in individual proposals or invoices. A non-refundable deposit of 30% is required to commence work. Final payment is due before delivery of final assets. Refunds are not issued after work has commenced, except at the sole discretion of Alex Beloev. No refunds are provided for completed deliverables.
5. Client Responsibilities
Clients agree to provide timely feedback, accurate brand information, and necessary approvals within agreed timeframes. Delays caused by the client may extend project timelines. Clients are responsible for ensuring all provided content (e.g., copy, imagery, trademarks) does not infringe third-party rights.
6. Limitation of Liability
Alex Beloev provides services “as is” and does not guarantee specific business outcomes (e.g., increased revenue or market share). In no event shall Alex Beloev be liable for indirect, incidental, or consequential damages arising from the use of services or the Site. Total liability is capped at the total amount paid by the client for the relevant service.
7. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved exclusively in the federal or state courts located in New York, NY. You consent to the jurisdiction of these courts.
8. Modifications to Terms
Alex Beloev reserves the right to update these Terms at any time. Changes will be effective upon posting to the Site. Continued use after updates constitutes acceptance. Last updated: March 15, 2025.
